Welcome to My Ardie. These Terms & Conditions (“Terms”) govern your access to and use of the My Ardie mobile apps, web app, websites, and related services (collectively, the “Service”).

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Eligibility

2) Resident-Only Access, Verification & Reactivation

2.1 Verification & Activation Flow

To use the Service, you must complete verification, which may include:

  1. Providing your full name, Arden address, email, and U.S. phone number through the web app.
  2. Verifying your phone number via a one-time passcode (OTP).
  3. If your address is within Arden and your phone number is not already linked to an existing account, we create an activation QR code and deliver it via postcard to your Arden address.
  4. To activate, you must scan the QR code, verify via OTP, and grant geolocation access so we can confirm you are physically within Arden bounds during activation.

2.2 Reactivation Every 6 Months

To help ensure only current residents have access, each account must be reactivated every 6 months using methods we determine (which may include OTP and/or geolocation validation). Failure to reactivate may result in suspension or termination.

2.4 Leaving Arden / No Transfers

Accounts are not transferable. If you are no longer a current Arden resident, you must close your account and stop using the Service. We may suspend or terminate accounts when residency changes.

4) Subscriptions, Free Trial, Billing & Refunds

4.1 Free Trial

New accounts receive a 1-month free trial starting on activation. After the trial ends, you must purchase a subscription to continue using subscription-gated features or continued access (as applicable).

4.2 Subscription Price

Current subscription price: $10/month (plus applicable taxes, if any).

4.3 Billing Provider

Subscriptions and payments are implemented through the web app using Square. You authorize us and Square to charge your selected payment method according to your subscription.

4.4 Changes to Price or Plans

We may change subscription pricing or plan terms with at least 15 days’ notice before the end of your then-current plan period.

4.5 Refunds

Refunds are case-by-case at our discretion, except where required by law. If you believe you were billed incorrectly, contact myardie1048@gmail.com.

4.6 Termination for Cause / No Refunds

If your account is terminated for violating these Terms or for fraud/misuse, you agree that no refunds are owed for remaining subscription time, unless required by law.

5) Community Content & Marketplace

5.1 User Content

The Service may allow you to post content including text, images, listings, comments, and messages (“User Content”). You are solely responsible for your User Content.

5.2 Marketplace Is Listings-Only

My Ardie provides a platform to post listings (buy/sell/giveaway/trade) and community posts. We do not process payments inside the Service and are not a party to any transaction between users.

5.3 Prohibited Content & Conduct

You agree not to post, request, sell, or promote:

We may remove content or suspend accounts at any time if we believe it violates these Terms or harms the community.

5.4 Complaints and Reviews

Complaints about the community/HOA/vendors are allowed, but must remain respectful and non-defamatory. We may moderate content to reduce harassment, misinformation, or unsafe behavior.

Geolocation may be required for activation/reactivation to verify you are inside Arden bounds. If you deny geolocation permission, you may be unable to activate/reactivate or use certain features.

10) HOA Disclaimer (Important)

My Ardie is not the Arden HOA and is not an official HOA communication channel. While we may reference or summarize information from HOA sources, official HOA documents and communications control in the event of any conflict.

11) Intellectual Property

The Service and all related software, designs, logos, and content provided by My Ardie (excluding User Content) are owned by My Ardie LLC and protected by law. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, lawful purposes.

12) User Content License

By submitting User Content, you grant My Ardie a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), display, and distribute your User Content solely to operate, improve, and provide the Service.

You represent you have all rights needed to post your User Content.

13) Privacy

Your use of the Service is also governed by our Privacy Policy: https://myardie.com/privacy.

14) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or that information is complete or up to date.

15) Limitation of Liability

To the maximum extent permitted by law, My Ardie LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us in the previous 3 months, or $50, whichever is greater.

16) Indemnification

You agree to defend, indemnify, and hold harmless My Ardie LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or your violation of these Terms.

We may suspend or terminate your account at any time if we believe you:

18) Arbitration & Class Action Waiver (Florida)

PLEASE READ CAREFULLY. THIS AFFECTS YOUR LEGAL RIGHTS.

You and My Ardie LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration rather than in court, except that either party may bring individual claims in small claims court if eligible.

18.1 No Class Actions

You agree to bring claims only on an individual basis. You waive the right to participate in a class action, class arbitration, or any representative proceeding.

18.2 Arbitration Rules and Location

Arbitration will be conducted in Florida under the rules of a recognized arbitration administrator (e.g., AAA) or another mutually agreed administrator. The arbitrator may award relief only on an individual basis.

18.3 Exceptions

Either party may seek injunctive relief in court for unauthorized use or abuse of intellectual property or to prevent fraud/security threats.

19) Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

20) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., in-app notice or email). Continued use after the effective date of updated Terms constitutes acceptance.
